New Jersey last week filed a petition for a writ of certiorari with the U.S. Supreme Court, asking the high court to decide whether prediction markets' sports-related contracts are gambling products regulated by states or federally regulated swaps products overseen by the Commodity Futures Trading Commission (CFTC). This move pushes the case, involving prediction market operator Kalshi, closer to a potential Supreme Court review. Legal experts believe the Supreme Court is likely to take up a prediction market case, especially after last month's Ninth Circuit Court of Appeals ruling created a circuit court split on the issue.
