Hong Kong Virtual Asset Trading Platforms and Regulatory Framework

The Hong Kong SAR Government is committed to building Hong Kong into a global digital asset innovation hub and has established a stringent virtual asset regulatory framework to protect investors while fostering industry development.

Regulatory System and Policies

  • VASP Licensing Regime: Hong Kong officially implemented the Virtual Asset Service Provider (VASP) licensing regime on June 1, 2023. All virtual asset trading platforms operating in Hong Kong or actively promoting services to Hong Kong investors must obtain a license from the Hong Kong Securities and Futures Commission (SFC).
  • "Dual License" Requirement: Platforms are required to apply for licenses under the Securities and Futures Ordinance and/or the Anti-Money Laundering and Counter-Terrorist Financing Ordinance to ensure comprehensive compliance.
  • Investor Protection: In the initial phase of the regime, only professional investors were permitted to participate, but the SFC reserves the policy flexibility to allow retail investors in the future.
  • Policy Roadmap: In February 2025, the SFC released the "ASPIRe" roadmap, aiming to build a safer, innovative, and open virtual asset market. In June of the same year, the Hong Kong SAR Government published the "Hong Kong Digital Asset Development Policy Statement 2.0," proposing the "LEAP" framework, reaffirming its vision to create a global digital asset innovation hub.
  • Regulatory Authorities: The Hong Kong SFC and the Hong Kong Monetary Authority (HKMA) are the primary regulatory bodies. Hong Kong Customs is responsible for regulating over-the-counter (OTC) virtual asset transactions. Hong Kong's regulatory philosophy is "same business, same risks, same rules," which involves looking beyond the superficial structure of financial products to examine the underlying assets and business substance.

The platform is listed on the HKEX (863.HK), audited by one of the Big Four accounting firms, and boasts up to USD 1 billion in client asset insurance, offering multiple layers of protection for investors. OSL supports trading of cryptocurrencies such as BTC, ETH, SOL, XRP, USDT, and USDC. Its maker fee for retail investors is 0%, and the taker fee is 0.05%. Licensed platforms are considered to offer stronger investor protection, but compared to offshore markets, the variety of assets available to retail investors may be relatively limited. Futu Securities, as an SFC-licensed institution in Hong Kong, also provides virtual asset trading services, supporting Bitcoin and Ether, among others.
