CFTC files motion to dismiss CME's lawsuit over crypto perpetual futures, arguing CME lacks standing
The Commodity Futures Trading Commission (CFTC) asked a U.S. federal court on Wednesday to throw out CME Group's lawsuit challenging the agency's approval of cryptocurrency perpetual futures. The CFTC argued that CME's claims of competitive injury lack legal standing and substance, stating that CME is free to list the same perpetual futures as a designated contract market (DCM). CME had sued the CFTC on June 18 over its May 29 order approving Kalshi's bitcoin perpetual futures contract, contending such products should be classified as swaps and that the CFTC circumvented regulations.
