Crypto Reporter: U.S. judges appear to be more sympathetic toward Uniswap developers; "neutral infrastructure" may be a key determining factor
Svmuu News: Crypto journalist Eleanor Terrett posted on X, stating that she had been reviewing the trial of Tornado Cash co-founder Roman Storm, noting that Judge Failla had drawn an analogy involving self-driving cars in user Nessa Risle’s lawsuit against Uniswap, appearing to show more sympathy toward the developers behind Uniswap while taking a stricter stance toward Tornado Cash’s developers. According to materials shared by Eleanor Terrett, the judge’s view was that holding software developers liable for strangers’ misuse of neutral infrastructure would be illogical—specifically, that Uniswap constitutes “neutral infrastructure”— while Tornado Cash is deemed to have “participated in illegal financial activities” (continuing to operate despite knowing it was being used for money laundering). This statement suggests that in future cases involving liability for decentralized finance (DeFi) infrastructure, U.S. courts may consider whether developers merely provided neutral tools rather than participating in illegal activities.
