National Association of Financial Market Institutional Investors: Strengthening Penalties for Violations Related to Bond Trading Records
Recently, during relevant business inspections and self-regulatory investigations, the National Association of Financial Market Institutional Investors (NAFMII) has discovered that internal controls are lacking at some institutions, compliance and risk management have become mere formalities, and the failure to maintain bond transaction records as required is a widespread issue. These problems severely hinder the accurate reconstruction of transaction details and undermine effective supervision and the enforcement of laws and regulations. In response to the above circumstances, the Association will intensify disciplinary measures against relevant violations. Institutions found to have the following issues will be dealt with strictly and severely, and will receive corresponding disciplinary sanctions based on the severity of the specific violations, including: 1. Failure to establish and improve internal control systems for the retention of bond transaction records in accordance with regulations; 2. Compliance and risk control measures are merely perfunctory, and internal control systems for the retention of bond transaction records have not been effectively implemented; 3. Bond transaction records do not maintain a complete audit trail throughout the entire process as required; 4. In the case of transactions suspected of serious violations of laws and regulations, institutions are unable to provide complete transaction records to reconstruct the true nature of the transactions; 5. Other acts that violate the relevant requirements for the retention of bond transaction records. (National Association of Financial Market Institutional Investors)
